The Fourth Court of Appeals will hear oral arguments in one appeal on Thursday, March 30, 2017, beginning at 9:00 a.m., before the following panel of justices: Justice Sandee Bryan Marion, Justice Karen Angelini, and Justice Irene Rios.
The following case will be presented:
Charles Edward Reed, Jr.; Amos E. Reed, III, Individually and as Representative of the Estate of Delores Perrin; Curtis Cullen Smith, Trustee of the Laura Dossett Smith Family Trust; et al. v. Maltsberger/Storey Ranch, LLC; Storey Minerals, Ltd.; Tom O Hanks; Karen R. Hanks; and TK Hanks Royalties, LP.
In this appeal, this Court must determine whether the oil and gas deed at issue conveyed a mineral interest or a royalty interest. If the deed conveyed a royalty interest, this Court must determine whether the deed conveyed a 1/4 floating royalty interest or 1/32 fixed royalty interest. Finally, this Court is being asked to determine whether issues on appeal have been preserved for appellate review.
